SHENHAV LLC DMCA POLICY

1. Introduction

Shenhav LLC (“Shenhav”, “we”, “our”, or “us”) respects the intellectual property rights of others and expects users of our website and services (the “Platform”) to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) , Title 17, United States Code, Section 512, we have adopted the following policy regarding copyright infringement claims.

2. Reporting Claims of Copyright Infringement

If you believe that any content on the Platform infringes upon your copyright, you may submit a notification of claimed infringement (“DMCA Notice”) to our designated agent identified below.

Your DMCA Notice must include all of the following information (per 17 U.S.C. §512(c)(3)):

  1. A physical or electronic signature of the copyright owner or of a person authorized to act on behalf of the owner;
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notification, a representative list of such works);
  3. Identification of the material that is claimed to be infringing, or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled, along with information reasonably sufficient to permit us to locate the material;
  4. Information reasonably sufficient to allow us to contact you, such as an address, telephone number, and email address;
  5. A statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, made under penalty of perjury , that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

3. Counter-Notification Procedure

If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our DMCA Agent.

Your counter-notification must include:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed or to which access was disabled, and the location where the material appeared before it was removed or disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the United States, for any judicial district in which Shenhav LLC may be found), and that you will accept service of process from the person who provided the DMCA Notice or their agent.

Upon receipt of a valid counter-notification, we may restore the removed material at our discretion, unless our designated agent receives notice that the original complainant has filed an action seeking a court order to restrain you from engaging in infringing activity.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Shenhav LLC has adopted a policy of terminating, in appropriate circumstances and at Shenhav’s sole discretion, users who are deemed to be repeat infringers. We may also limit access to the Platform and/or terminate the accounts of any users who infringe any intellectual property rights, whether or not repeat infringement is involved.

5. Reservation of Rights

Shenhav reserves the right to remove or disable access to any content alleged to infringe copyright, and to terminate accounts, at any time and for any reason, without notice or liability. We also reserve the right to update this DMCA Policy from time to time incompliance with applicable law.
